KAZIGIGS — TERMS & CONDITIONS

1. Agreement to Terms

This agreement ("Terms") is a legally binding contract between you ("User," "you," or "your") and KaziGigs ("we," "our," or "us"), a service marketplace platform.

By accessing, browsing, or using KaziGigs through any means—including our website, mobile applications, or related services—you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions, together with our Privacy Policy.

If you do not agree to these Terms, you must immediately discontinue use of the platform.

These Terms apply to all users accessing KaziGigs in the Republic of Zambia, the United Republic of Tanzania, and any other jurisdiction where we operate.

2. About KaziGigs

KaziGigs is an online work marketplace platform that facilitates connections between businesses and individuals seeking services ("Clients") and independent freelancers and service providers ("Service Providers").

2.1 Platform Services

Through KaziGigs:

  • Clients may post job requests, service requirements, or project briefs
  • Service Providers may submit bids and proposals (limited to one bid per job posting)
  • Parties may communicate directly through our secure messaging system
  • Parties may negotiate scope, deliverables, timelines, and pricing
  • Payments may be held in escrow to protect both parties
  • Platform service fees apply to completed transactions

2.2 Platform Role & Limitations

KaziGigs operates as a technology platform only. We:

  • Do not employ, supervise, direct, or control Service Providers
  • Do not endorse, warrant, or guarantee the quality of services
  • Are not a party to contracts formed between Clients and Service Providers
  • Are not responsible for the conduct, performance, or disputes between Users
  • Do not verify credentials, qualifications, or representations made by Users (beyond KYC requirements)

All contracts for services are formed directly between Clients and Service Providers. KaziGigs provides the platform infrastructure only.

3. Electronic Communications

By accessing KaziGigs or communicating with us electronically, you consent to receive communications from us via:

  • Email to your registered address
  • Mobile push notifications
  • SMS text messages
  • In-app messaging
  • Platform announcements

All electronic communications satisfy any legal requirement that such communications be in writing. You may opt out of promotional communications but cannot opt out of transactional or service-related messages.

16. Property Damage and Liability

16.1 Client Property

When Service Providers perform work that involves access to Client property, facilities, or equipment:

  • Service Providers are solely responsible for any damage, loss, or injury caused to Client property during service delivery
  • Clients should verify that Service Providers maintain adequate liability insurance before engaging services
  • Service Providers must immediately report any property damage or safety incidents to the Client
  • KaziGigs is not liable for property damage, loss, or injury resulting from services performed through the platform

16.2 Third-Party Property

For services performed at third-party locations or involving third-party property:

  • Service Providers must obtain necessary permissions and comply with property owner requirements
  • Both Clients and Service Providers are responsible for ensuring proper authorization
  • Any claims from third-party property owners are the sole responsibility of the User(s) involved

16.3 Insurance Requirements

Service Providers are strongly encouraged to maintain:

  • General liability insurance with minimum coverage of USD $1000 (or local currency equivalent)
  • Professional indemnity insurance where applicable to their trade
  • Workers' compensation insurance if employing assistants or subcontractors

Note: Insurance requirements may be mandated by Clients for specific high-value or high-risk projects. Service Providers must disclose their insurance coverage status when bidding on such projects.

16.4 Platform Limitation of Liability

KaziGigs expressly disclaims all liability for:

  • Property damage, destruction, or loss occurring during or as a result of services performed through the platform
  • Personal injury, death, or health impacts arising from services
  • Damage caused by Service Provider negligence, incompetence, or willful misconduct
  • Fire, water damage, structural damage, or any other form of property destruction
  • Environmental contamination or hazardous material exposure

Users acknowledge that all property damage claims must be resolved directly between the Client and Service Provider, or through their respective insurance providers.

16.5 Dispute Resolution for Property Damage

In the event of property damage disputes:

  • Parties must document damage with photographs, videos, and written descriptions
  • Parties should obtain professional damage assessments or repair estimates
  • Insurance claims should be filed through the Service Provider's liability insurance
  • KaziGigs may, at its sole discretion, facilitate communication but is not obligated to mediate or resolve property damage disputes
  • Unresolved disputes must be pursued through applicable legal channels as outlined in Section 22 (Governing Law & Dispute Resolution)
